NAR - the Ultimate Wolf in Sheeps Clothing

NAR - the Ultimate Wolf in Sheeps Clothing
Time to Hold NAR Accountable
to Those Code of Ethics
that are Simply Gibberish
they make Newbies Swear to
But have No Intention
or System in Place to
Make this REALLY Happen.

Time For the Truth About
the National Association of Realtors.

the National Association of Realtors is a Hoax.

NAR is NOT of a "Higher Standard" as they Claim to Be.

NAR does not Provide Consumer Protection in ANY way.

The National Association of Realtors NEEDS

you to REALLY buy into the Illusion that they
are the "Voice of Real Estate"
that way you will Simply not know that you can use
a Real Estate Broker that is NOT Part of the
Real Estate Cartel known as
National Association of Realtors.

And You Believe that an NAR Member Offers you
More Protection in your Real Estate Transaction
When In Fact that is a Flat Out Lie.

NAR is so Engrained in your Life that ALL of you Use
the Word "Realtor" for the WordS "Real Estate Agent"
though NAR tells me that is Illegal. Law Books Do it, you Do it
But NAR wants to STOP me from Doing it.

The National Association of Realtors
Violates Anti-Trust Laws, Violates Mortgage Laws,
Violates RESPA Laws, they pay Attorneys to
Advise members at the State Association Level
that is Information Biased on What NAR Needs
to be the Course of Action, to Keep NAR in Business.

Even to the Point of Convincing Members they
are doing something Illegal when they try and
benefit the Real Estate Consumer.

NAR Pushes State Real Estate Governing Agencies
to Make E and O insurance Mandated -
when in FACT this E and O insurance is What Enables
the Realtor to Legally Committ Fraud and
there is nothing you Can do unless you have
BIG Money and a WHOLE lot of Years to Fight.

The National Association of Realtor IS NOT the
Voice Of Real Estate. NO WAY.

Who Really Makes the Money from all that the National Association of Realtors is In the Business of SELLING.. with YOUR listing of course...

Who makes money from Realtor Magazine, from the Realtor Associations that Pay for the Magazine, Who makes money from Electronic Keys, from REALTOR books, REALTORS® Accreditation's, REALTORS® websites, REALTORS® stickers - shirt - jackets, REALTORS® advertising in those magazines and on those websites, or how about Lowes - Dell and other companies that make deals to sell to REALTORS®, how about insurance company affiliations with REALTORS® , Relocation Company Affiliations, Who Makes the actual money from all these associations and the publicly traded companies that benefit from NAR.. what about Cendant, Realogy, Homegain and all those companies who really own each other and own part of Realtor.com - the National Association of Realtors is a Mult-Billion Dollar business built on Real Estate Illusions and is a Mega-Money Making Machine that reaches all sectors of Society and it is done on your dime, your blood sweat and tears and offers you NOTHING in return.
R
One might say wow NAR creates lots of jobs, every sector has a hand in it. Well NO these builders, companies of all kinds that get work within the "Realtor" system do it out of necessity, they would have these same jobs even if NAR did not exist, the only difference is the GREED at the TOP of NAR would not get a piece of the Pie.
R
NAR is not necessary, Real Estate Agents only join because they are forced to. NAR says that it is Choice, but really if you don't join you have to come up with forms, you don't get access to the secret MLS Cartel Data, and the REALTORS boycott your real estate for sale.. so you pretty much have to join.
R
But if NAR, the National Association of Realtors did not exist well then YOU the Real Estate consumer would get a better, more accountable service from your Real Estate Broker.
The affiliations, Clout, insurance, Special Interest, Big Money and E and O insurance that the National Association of Realtors has is very bad for the real estate consumer. If they were not such a Cluster.. a Powerhouse with all their "Pulling of Strings" ability, well then When the Real Estate Consumer proved Obvious Fraud, Blatant Non-Disclosure, Flat Out Lies and Silent Fraud well then the Real Estate Agent would be accountable. But with NAR behind them .. they simply are not held accountable and the System in Place firmly protects the "Realtor" over the Real Estate Consumer. And the Real Estate Attorney system in place goes right along with that.
R
STOP Using Realtor
Demand Accountability.
Do NOT support Mandatory E and O Insurance.
Hold Realtors Responsible for Flat Out Lies that RUIN your LIFE.

Pending Home Sales Rise for Record Eight Straight Months

"Washington, November 02, 2009

Pending home sales rose again, marking eight consecutive monthly gains – the longest streak since measurement began in 2001, according to the National Association of Realtors®.
The Pending Home Sales Index,* a forward-looking indicator based on contracts signed in September, rose 6.1 percent to 110.1 from a reading of 103.8 in August, and is 21.2 percent higher than September 2008 when it stood at 90.9. The gain from a year ago is the largest annual increase on record, and the index is at the highest level since December 2006 when it was 112.8.

Lawrence Yun, NAR chief economist, said the momentum is understandable. “What we’re witnessing is a rush of first-time buyers trying to beat the expiration of the tax credit at the end of this month,” he said. “Home values will stabilize sooner rather than over-correcting. That, in turn, will mean wealth stabilization for the vast number of middle-class families and lay the foundation for a durable economic recovery.”

R
Folks don't forget the lies that Lawrence Yun told you that got you into this mess. Don't forget that the NAR President is quoted as Saying it is a Good Time To Buy, when the Market was obviously failing, it was in the news - the blogs and obvious on main street America but the REALTORS at the highest levels told you to Buy and Well you Did and now they are telling you FALSE information again to gain your confidence... they LIED.. don't Forget it.

Also NAR Statistics are NOT accurate. The MLS's I was part of had no way to provide any kind of quality control over the integrity or accuracy of the data in the MLS and this Data is what Lenders, Mortgage Brokers, Realtors, Appraisors used to Create a False Market that was destined to Collapse. But who cares the CEO's got Rich.. took the money and tucked it away, then when bankrupt and put their hand out begging your government for your tax dollars.
R
Now they are foreclosing on your life, when they should be reducing the amount of your loan, they got relief - YOU did not. They made money off your loan, they got a bailout - your stuck with your loan that they get to keep making money from. ENOUGH.
r
The Realtors, the National Association of Realtors has NO Credibility what so ever. THE National Association of Realtors is banking on your ignorance, vulnerability and the fact that you will believe them as the "Authority" - the "Higher Standard" when in TRUTH they are telling you Flat Out Lies, Making Stuff Up and Creating Illustions... NAR - the Great Real Estate Hoax.
R
NAR "Research" has no base in any kind of Reality. They told you false statistics for years, you listened, you were so confident that you PAID way to much for YOUR real estate, and now you owe hundreds of thousands more then your real estate is worth. Oh Well NAR is out to help you with Tax Credits and GOOD News that the Pending Home Sales are Up.. so Breath easy.. Time to Buy, Oh and Don't Forget to Use a Realtor.. that is the point of their Statistics, their Research, their Clout.. Right? R

NAR can tell you ANYTHING, how do you know if it it True or not? You don't? You simply believe them as the AUTHORITY on Real Estate, the "voice of real estate" because of their CLOUT, their Propaganda - Billboards - Ads and because they State their Statistics and Research so firmly.. yet in TRUTH the Political Agenda, Special Interest Groups, Lobbying and Suckering you into thinking you Need a Realtor... this is all to get you to Keep using Realtors so that the National Association of Realtors Billion Dollar Money Machine Keeps on Working.

Who Cares if Lawrence Yun lies or just gets the data wrong, who cares if NAR flat out lies or mis-reads data, they can always blame bad data or whatever.. no one holds them accountable even with news archives of them telling you to BUY just before the Collapse that they SURELY knew was coming and if Lawrence Yun did not know, in some fantasy land of delusion well then what Kind of a Chief Economist is He. Lawrence Yun, YOUR FIRED !!!

Get Realtors, NAR, the National
Association of Realtors out of Real Estate for Good.
R
STOP Using NAR members in your Real Estate Transaction. HOLD the National Association of Realtors accountable for the Industry Trends, Pending Home Sale Data, SOLD Data, and False Consumer Confidence they spew year after year. the National Association of Realtors is Lying to You, don't fall for it again.r

A bank bailout without REAL consumer relief is Bad Business, Fraud, a Blatant attack on the Real Estate Consumer,

Banks taking Short Sales, whereby they sell for less then the Loan to get the Real Estate off the BOOKS, but they won't offer this Price to the Owner because it is Illegal.. .. this is Unethical, a Stranger, an investor can get your home for 30 to 60 percent of your loan but you can't - why is this. If it is law and well mortgage fraud if you do it then why is it not mortgage fraud that the Lenders blatantly did this to you in the first place.
R
They allowed false appraisals, they allowed values to come in at 10% higher and well keep adding 10% and OMG you got 100 percent then 200 percent .. gee I don't know think it would lead to a Collapse? Think that the Real Estate Consumer should be the one to pay for their Stupidity, Fraud, Lies, and Corrupt Greedy Behavior. No Way. Don't Believe any of the Greedy Fools that got the Real Estate Industry into this mess and NAR is at the TOP of the HEAP....

PS. It is NOT a Good Time to BUY unless your getting 50% off of what the property was listed for a Year ago. (This Excludes Lakefront Real Estate) Yes Sad for Sellers, but Lenders, NAR, Banks, and the DEPT of Justice should be Lobbying and enacting laws to get Sellers out of those Liars Loans, those Loans they got based on the lies and false consumer confidence of NAR and those Loans that are NOW way more in "Pay Off" then you could possible Sell your Real Estate For.

More Anti-Consumer Laws... State Real Estate Commissions and Boards DO protect NAR..

Laws such as the one I am about to Mention PROVES my POINT. State Governing Bodies Protect REALTOR big time.

Here it Is...

"County of Los Angeles Department of Consumer AffairsNew Consumer Laws 2007"

"Real Estate Agents: Can’t Lie About Qualifications

B&P Code Section 10177

Current law provides that willful misuse of trade names, including “realtor”, are subject to discipline by the Real Estate Commissioner by revoking, suspending or denying a license.
This new law strengthens prohibitions against real estate agents from falsely claiming membership in trade organizations or falsely claiming to have special designations or certifications.

This law prohibits knowingly authorizing, directing, or aiding in the publication, advertisement or distribution of any false statement or representation concerning a designation or a certification, including trade organization membership.

The Real Estate Commissioner is authorized to suspend or revoke a real estate sales license for this violation."

So this DUMB - Dispicable - Anti Consumer Law makes it so that Realtors cannot use TRADEMARKS of Realtor, makes it so Real Estate Brokers that are not REALTOR - NAR members cannot even use the Word Realtor on there website even if they are talking about a Realtor - an NAR member or they Will Lose their Real Estate License.

Laws Enacted CLEVERLY disguised as Consumer PROTECTION but are obviously one more way to Force you to USE a Realtor, NAR member and to Force Real Estate Brokers to be Realtors but then say it is a Choice to Join NAR - if they cannot in Good Faith make this claim then they are deliberately and obviously violating Anti-Trust Laws.

So If I were a Real Estate Broker in California and used the word Realtor I would be falsley claiming "special designations or certifications"? what a Crock...

Consumers wake Up, State Real Estate Commisisons are FORCING - NAR members on you at the same time NAR is saying it is a Choice for us as Real Estate Brokers to join their "association" - which I call a Real Estate Cartel. And this above information is from the Department of Consumer Affairs - are Governing Bodies really that clueless to the Anti-Consumer tactics of NAR?

So in Los Angeles, If I were licensed their and I said Confession of a Realtor, or Realtor ...., or talk to your Realtor about... , or Realtors are lying to you... well I would lose my Real Estate Brokers license... Tell me NAR does not control State Licensing boards and Real Estate Commissions - and I say that is a Flat Out Lie.
r
Also NOTE that being a REALTOR is NOT a "Qualification" OF ANY KIND - you pay a fee to join, you Promise to uphold Ethics and Standards of Practice that no ones holds you accountable to - sure you have continuing Education so what you would have that if you were not a NAR member as well - you pay a monthly and yearly fee to be a "Realtor" - it is NOT a Qualification.... NAR Propaganda and LIES Posted By Charles McMillan - Crystal Cox Broker Owner Says Look Deeper - NAR does NOT want to Hear from you...

"Give Credit Where It’s Due, Posted By Charles

According to NAR research, the percentage of first-time homebuyers has risen from roughly one-third of all buyers in January to just under half in March and April. Why the sudden jump??
The answer is simple: those buyers have an $8,000 incentive, in the form of a tax credit, to buy now.

We’ve heard from a lot of members lately who would like to see the tax credit expanded.
I recently asked our Chief Economist Lawrence Yun what the impact on the market would be if Congress extended the credit through 2010 and offered it to all homebuyers. According to Lawrence, those changes could result in 800,000 additional home sales this year, raising the total from 5.4 million to 6.2 million. That would certainly take a big bite out of inventory and help stabilize prices.

And, that’s not all…
When you consider that for each home sold in the United States $62,000 is pumped into the national economy, the resulting impact of expanding the credit could be nearly $50 billion. That’s what I call a true economic stimulus!

NAR is working with members of Congress
r
to introduce legislation
r
that would expand and extend the credit. We will keep you posted on those efforts in the months ahead.

In the meantime, we would love to hear your stories about how the tax credit is helping consumers in your local markets. Post your experiences right here on the Voices of Real Estate blog, and we’ll share them with lawmakers. Help us tell Congress to give credit where it is due – to ALL homebuyers. – Charles McMillan, 2009 NAR President "

**********
What Do you Consumers Think?
r
Do you think that this $8000 Credit for first time homeowners is a big deal? Well it sure did bump up SALES, according to Charles McMillan, so it MUST be good. Sure is a GOOD thing that NAR lobbyed / advises ... blah .. blah ... blah.. to get this one in to "stimulate the economy". Translation $8000 is NOTHING, seriously NOTHING, if a mortgage broker is involved that will barely pay the Lending and Mortgage Broker fees of a no money down loan. But that s the point right, just enough to get them in, to pay those PROFESSIONALS and too stimulate the Economy.
r
$8000 will not make a down payment, but who cares it gets you in... then the Seller can pay the Realtors 6% so say around $18,000 on a $300,000 Home. Yee Haw, the Realtor gets a big fat pay check. The BUYER gets into another Greedy Grubbing Bad Loan where almost one hundred percent of their monthly mortgage payment goest toward interest and is money to the banker, to the mortgage broker, to the lender and this HUGE debt is an ASSET on the BOOKS of the lender and they can actually use this asset to trade, to get loans, to juggle really BIG money on your DIME... and for decades or until SORRY you lose your HOME.
R
Don't let anyone kid you, Realtors want this CRAZY incentive to get them back in the full swing of Selling You Real Estate. You know as well as I do that $8000 won't get you far, but it sure does get a Cha - Ching for a Realtor somewhere.
R
This is ONLY to benefit Realtors and buyers may feel great at first, wheeee WE got a home but that will wear off and you will have to sell and the Handy Dandy Realtor will be there to MAKE MONEY again and again off you SITUATION... they GOT YOU IN...
r
The Cycle Continues.. this Year Charles McMillan at the Helm...
r
NAR working with Congress to CREATE Legislations... Worry Folks, Real Estate Consumers Rise up and Tell NAR to get OUT of your Business. NAR "works" with Congress on what is Good for NAR not for you... unless you just happen to benefit from something they do, it is NOT the PRIMARY goal.... they are Realtors, they are an ASSOCIATION, me as a Real Estate Broker supposedly get to CHOOSE whether I am a Realtor or NOT ... yet NAR - gets to be the Voice Of Real Estate Lobbying, Working with, Advising your Government on what is best for you...
r
mean while NAR has no accountability for the agents in your town who Fail to Disclose Known Defects, who committ deliberate and obvious fraud, who violate the Ethics and Standards that NAR so BRAGS about, NAR Fails to police MLS data for QUALITY, NAR does not listen to Honest Law Abiding Broker Owners who try and Really change the real estate industry for the better, NAR does NOT, Cannot or Will NOT do what they promise to do in ANY way, and yet their AGENDA is to "Work with Congress" to supposedly make things BETTER for Consumers ?????
r
Consumers NEED to "Work with Congress" and Get Realtors out of the Middle of Their Real Etsate Transaction.
r
If NAR cannot even uphold the bylaws, member rules, codes, ethics, standard of practices and other Lying Promises they make to us as Realtors and we in turn Make to Real Estate Consumers then Fire NAR... don't let them work with congress on your behalf.
r
Is Congress foolish, did they not see the mass NAR "Agenda" of Buy - Buy - Buy all the while media everywhere talked of an ecoonmy collapse, talked of the secondary market and how bad it really was and yet Realtors said to BUY.. now they are involved with, WORKING WITH CONGRESS, to see what else they can take from the Real Estate Consumer.... who Will STOP NAR ? My guess is no one.
r
And you will continue to SUFFER every day for the NAR's lack of holding Realtors accountable for what they do that Takes Your Life as You know it Away Forever while they get to keep on making money at real estate, get away with fraud - lies and deception years on end and NO one is watching. Guess NAR is too busy WORKING WITH CONGRESS to give a Rats Patoot about what is Going on in the Real World of Real Estate that Really affects YOUR LIFE... whatever as long as NAR stays in Business and I mean VERY - very BIG Business.

NAR - the Realtors said Buy - Buy - Buy - Short Sales Specialist Hogwash..

Even when they knew the System was failing they said Buy... Now the Realtors are specializing in Short Sales, in Rescuing You from Foreclosure. The same Foreclosures they got you into in the First Place.

NAR is really pushing Realtors to get into foreclosures, newsletters, courses... and all their jargon and nonsense to KEEP Realtors in the Money... Your Money.

Saying that your a "Short Sale Specialist" is just the latest gimmic, add it to GRI, to Accredited Buyers Representative, Commercial Expert, Ranch Specialist..... all just labels.. hey I SOLD one, I am a "Specialist". Realtors, NAR, is still trying to Pretend they are Part of the Solution ..

Why Doesn't the National Association of Realtors just sit down and shut up. They are coming to your rescue, more like NAR is pretending to in the media and the arepushing their "political clout" - "political agenda" on your law makers to take action that really is not best for the real estate consumer.
r
The Realtors pretending to be part of the fix for Economic Issues that they in a BIG part helped to create is quite a joke.
r
While your losing your home, while your home is worth way less then when your Realtor talked you into buying it, the Realtors are still making the same wages.
r
Don't buy into the New Realtor games, they are no pretending to Get Technolgy, you don't need to use a Realtor to Sell your Home. The Internet is there for you to sell your home for FREE. Pretty much all buyers are looking online for what you have to sell, and the Realtors are in direct competition with you. If you sell as a FSBO the Realtors Loses and you have more protection.

On the Side of the Realtor, NAR Member - You Lose

The National Association of Realtors will stop at nothing to make sure that you have to use a member of the National Association of Realtor, hence a “Realtor” in your real estate transaction.

Realtors Lobby in Washington D.C. constantly to keep you down, to make sure they are needed and to ensure that laws are passed that “are in your best interest” only these laws are directly against the real estate consumer for the benefit of the Realtor. They push for laws to make sure they keep their hands in your real estate transaction. They control your data, your sale, have their hands in your mortgage laws and more.

If Realtors, Even Real Estate Agents want to cut real estate costs and to use the power of the Internet to market and sell real estate in a way that makes it cheaper and safer for you, the National Association of Realtors will squeeze them out. Those giving you better service for cheaper money online, and emailing often to keep you involved - the State Boards want them to go away. The Realtors, convince these boards that it is your best interest or force them to change the State Laws by pressure, money and political power.

The National Association of Realtors has convinced the State Lawmakers to make your “Real Estate Brokerage” have an office to be ready to write a contract. With the Internet this is ridiculous but State Law makers such as a letter I just got from the Idaho Real Estate Commission, they are making it Mandatory to be Available in person, ridiculous when the buyers are on the Internet.

But it is simply a way to keep the Big Boys, the Franchise and the National Association of Realtors in business a bit longer until the Real Estate Consumer wakes up and realizes that they have once again been duped.

I Don’t understand how the National Association of Realtors can convince lawmaker to make laws that are no where near “legal” or based on your constitutional rights, but oh well the National Association of Realtors owns your real estate transaction and as long as you use a Realtor, you keep them in business. This stuff affects you and you are left way out of the loop.

Using your State and Federal Laws against you is a favored past time of the National Association of Realtors and they are just getting started on the biggest battle in all this. So you will see new laws and real estate licensing mandates pop up left and right in hope to stop Real Estate Agents like me who charge $50 a year for you to market yourself vs. those National Association of Realtors Offices in your town which charge 6 or 8 percents, treat you badly, have forms for you to sign that protect them and not you and have insurance to protect them from you - even if they lie outright.

What is the definition of being “available” well 24 - 7 on the Internet is not what they have in mind. They want your real estate agent ready to receive and write contracts at any time. This is in no way best for the real estate consumer, they Real Estate Commission, say in Idaho, pretends it is best for buyers and sellers if we have full time staff, but in the world of the Internet it is not best. It costs you more.

You Deserve Better then you are getting. Let you State Real Estate Commission, Board of Realty Regulations or whatever they call the governing body in your state that you won’t stand for this anymore. The National Association of Realtors pushes lawmakers, they have lots of money and they do not information the public or give you a right to choose, and your State and Federal Lawmakers do what Realtors want.
r
They do this either to Shut them up or if the National Association of Realtors has actually convinced them that is in the consumers best interest. I have read documents, some are posted at www.SavvyBroker.com that show where E and O Insurance Companies and the National Association of Realtors convince State Boards to make E and O insurance Mandatory, they Flat Out lie at these meetings with states like E and O insurance is, in part to protect the consumer and in part to protect the “Realtor” from “frivolous lawsuits”.
r
I have experience with the kind of “frivolous lawsuits” Realtors are protected from and this means that if you lose your home, life savings or have serious issues with your property that they sold you, oh well, they can legally lie and the E and O insurance will protect them.
Even though they pretend to be for consumers as well when at your State Realty Board Meetings, they email me a Broker Owner and Tell me that my E and O insurance is “not intended” to protect my clients.

NAR is gearing up to make sure that you have to use them… they will get laws changed, control your state and federal real estate governing bodies and will be all about creating Revenue for Realtors and not about Protecting you At All as a Real Estate Consumer.

They say that being a NAR member is not mandatory, but they block non-members at every turn in the road. Forms yes, MLS, but also the bigger issues. They want the Dept. of Justice to think that Real Estate Agents can do business without being a Realtor and that we choose to be a NAR member because it is of a higher standard, but this is in No Way True, we have few choices left even as a Broker Owner. And the National Association of Realtors owns and controls your State Real Estate Regulators... You Lose.
r
Also ref. a New Idaho Law, More on that Later, where I have to be "Available" for contract writing, not here online but all staffed up, have an Idaho storefront and the whole deal, this is true in Washington as well and is a way to squeeze out the Online Brokerage that are working harder and smarter for you, keeping you more informed, giving you cash back and well treating you with the dignity and respect you deserve.

the Bubble Has Burst .. Who Will it Really Hurt ?

The headlines Read the Bubble has BURST - The Nightly news talks of 30 percent housing prices dropping in some areas. And they say the prices will keep falling until at least next summer. The houses really hit are the over built areas, houses in subdivisions and next to each other. Some folks have money and the loans will now be VERY cheap. So there are still buyers. And in recreational area, where homes are on over 5 acres with views - water - and such, it is my opinion that buyers are still buying at quite high prices. Homes on small acreage are not doing so well.

All the While Big Companies such as Coldwell Banker in My area were assuring the public that all was well. Those who should have known all this was coming and stood idle. The Realtors knew what was really going on and did nothing to Watchdog, to Lobby to Fight to Change it, they wanted the Gravy Train to keep on coming their way.

The SHOCK of all this is the Real Estate Consumers that are losing and have lost their homes are the ones hurt by this, obviously. However, the Lenders that got them into this are Getting their Government Bailout. The Mortgage Brokers are still getting those loans out and making plenty of money doing whatever it takes to close the deal. The Realtor on the Nightly News (yes they called this gal a Realtor.. even though NAR says I cannot say that someone is a Realtor.. I have to say they are a Real Estate Agent that is a Member of the NAR.. blah blah... You cannot Use Realtor as a Synonym for Real Estate Agent.. though EVERYONE does.. NAR calls it a trademark violation and it is bad.. but only for a few of us...) and way the Realtor said it is VERY busy for her, buyers are looking - and some are buying because Yes indeed it is a Buyers market, so those who do have money and the ability to get loans will swoop in and get properties for very CHEAP. Most will use a Realtor and a Mortgage Broker, who will in turn use an appraiser and those Lenders that got their bailout will begin loaning again.

NAR is making plenty of money advertising foreclosures, fighting to get mortgages flowing, starting a NEW Realtor Credit Union and forcing development even when there is so much already that houses are standing empty.

Yes Buyers had a choice to get into those loans, but Buyers really believe that the "Value" was there. The Realtor - Mortgage Broker - Appraiser and Lender all assured the Real Estate Buyer that it was the True Value of the Home. The Lender knew that they were giving loans that were more then the home was worth. They actually knew that the Realtor - Mortagage - Broker and appraiser had created values that were to high, they actually said that if it is 10% above the real value then that is ok.

So if they knew of at least 10% in the price increase then there was a whole more percentage that was "fudged" behind the scene to get the value up. And where did the 10% rule end, it didn't end so at random prices increased higher and higher Falsely. Each 10% led to another and the values kept rising but it was not making economical sense. People sensed that something was not quite right but hey the Realtors say it is Ok, and the lender will give me the money so it must be ok.

So Those who got the Real Estate Consumer into this will still keep making money from it. The Foreclosure Companies list with in house franchises or affiliated franchises so those Big Companies, most who are owned by Realogy-Apollo Management.. they get to keep making Huge Money.. Billions but what do they do with this money, well I THINK they hide it.. because they too seem to be getting in on the Bailout Game with the Hand Out for Help.. the Let's take the Real Estate Consumer's Money and Go Bankrupt... Search the News folks.. this stuff is true.. and what I say about the 10% thing.. that is True.. I have seen False Prices, forced closings.. and things like Sellers Contributions were a Flat Out Crime in my opinion...

I mean a house is valued at say $200,000, and the buyer has no down payment, a seasonal job, and the lender requires at least 5% as a Down Payment. The Buyer has NO money, so they talk the Seller into, or shall I say the Mortage Broker directly talks the Seller into or has the Realtor talk the Seller into raising the price to include the furniture so the Buyer will not have that expense, maybe even raise the price and throw in a car.. and certainly raise the price so that their will be that 5% down payment the buyer needs so the Lender will give them the loan, that 5% or more that the buyer simply does not have - but hey the Mortgage Broker and the Realtor promised a miracle and they will pull it off.

So get the Buyer the Loan QUICK while they have a job, no big deal later when the job ends.. or situations where buyers get into loans with the current job to buy elsewhere - knowing that they are moving and quitting that job, and the mortgage broker tells them that this is the only way to get it through.. and Of Course that is the Whole Point Right.. Just Close the Deal.

So the price raises, and as this happens over and over and years roll by, the Value Rises but it is not real with the Economy it is a Made up Value based on the Games that Happen behind the closed doors of the real estate transaction. And what will stop all this from happening all over again.. nothing really. People will come in and buy those foreclosures and re-sell it to the consumers who lost before, some that buy now will even finance it to those consumers for a high interest rate, and those who lost their homes before will have no choice, if they want to own.

Things like this happen every single day.. where does it end.. no where.. when things collapse it just finds another way.. the only hope you have to Protect your Family and your Assets is to Know More about all of this.. don't trust the Realtor.. folks they may be the nices - honest person but they also simply may not know enough to protect you, they cannot protect you from the lies of those on the other side of the transaction, they simply can not do what you, the Real Estate Consumer think they can...

Please.. Know More BEFORE you Sign... don't believe ANYONE that is paid based on your transtion closing...

Those who Created - Allowed - Encourage the Problems that the Real Estate Consumer is NOW facing are the very ones who will now again benefit from the opposite side of the coin. Except for those Realtors who don't get internet marketing or don't work for the Big Franchise who gets to list and sell all the foreclosures they helped to create.

Report: Brock Realtors

Brock Realtors unprofessional, lying, manipulative, crooks. I had been with Brock Realtors for 5 years. The property manager Karen is a unprofessional business partner by rude comments and her father, the owner, is a swindler. Ripoff Fort Worth Texas.

Had been a tenant for 5 years, the property manager had alwyas been cooperative and very helpful. Dont know if she hit menopause or what but became rude and disrespectful to me and my business partners. I was then introduced to her father who had a home for sale that he had owned for 20+years and he was so nice and helpful then when the big problems starting arising with the property like no working bathrooms , the windows dont close all the way, rotting floor in the bathroom, and many more. I proceeded to buy under the provisions to get it all fixed by closing. Closing is in a few days and NOTHING has been fixed, when confronted with a formal statement he evicted me from the property. I have 2 small babies and for those people at that company who I felt knew me very well all the sudden became the enemy in about 5 minutes. Sweet at first then saw what they ARE REALLY LIKE. Watch out for them, they are slick..

Did My Realtors Lie to Me??

First IndicatorI closed on my property during the first week of February. When I arrived at the closing my realtor handed me a slip of paper with contact information for a potential tenant. I was immediately worried; was one of the tenants moving??

My realtor said no, they just periodically got calls about it and the soon-to-be former owner wanted to pass the lead along to me. OK...I saw the seller's agent come out (who I had met before), and I asked him as well if any tenant was planning on moving. As he ran out the door he said "No, tenant B's been grumbling about moving, but that's not likely. She's lived there for 20 years after all. Bye!" OK...Second IndicatorEarlier this week my realtor forwarded me an email from the previous owner with yet another tenant lead. What the heck? Do they know something I don't? Keep in mind that DAYS before the closing Tenant B signed a lease agreement to satisfy my lender (she didn't have a written lease before that).

In it she pledged to stay for 12 months and pay month to month. If she/the agent/the owner knew she was planning to move and had her sign a lease anyway then that's obviously unethical at best.Really Starting to WorryRent from said tenant is due 2/15 and is late on 2/20 (today). So today I drove (flew) up there to give her a very formal, simple notice that her rent is late and requesting immediate payment. And to peek in the windows and make sure it looks occupied. I was already starting to put the pieces together and freak out a little.

Maybe It'll Be OK?Well, she had some mail in the mailbox, though I couldn't see through any windows. I did talk to the other tenant who said he's been seeing her every day except for the last couple. Then he mentioned that her live in boyfriend had moved out 3 weeks earlier. "She might have moved out too," he shrugged. I thanked him and left, feeling slightly better.

If she'd been there recently then she surely got my letter and knew where to send the rent. And unless she moved out YESTERDAY then she obviously still lived there...Wrong!

But I still wasn't settled, so I emailed the previous owner and politely explained the situation and asked if she had any other contact info for tenant B. She assured me that "that number" (to the adult entertainment hotline; see previous post) was correct and that the tenant would probably call me back. Then she said "She did tell me that she was moving back to Arkansas and would be out by February 15th. I thought [the realtor] would tell you this. He said it would probably work well for you as you wanted to go in and do some of the repairs."EXCUSE ME?!?! So I promptly forwarded the message to my realtor with the following message:

"What the hell? I can't believe you guys didn't tell me this. I knew it was fishy that you were passing along potential tenant contact info to me even before the closing. I specifically asked [the seller's agent] at the closing if any tenant was planning on moving, and he said no right to my face. Specifically I remember him saying "Oh, the lady in unit B's been grumbling about moving eventually, but that's not likely. She's lived there for 20 years, after all." This is absolutely unbelievable. And I know she was planning the move WELL before the closing, because Tenant A told me so today, and said the boyfriend went ahead and moved 3 weeks ago.

I can't believe this."Ok, so I was freaking out a little. He called me immediately and insisted that he didn't know anything about this. He went on about his morals and ethics and how he values helping his customers and would never withhold information. He said he'd emailed the seller's agent and instructed him to give me a full explanation of the timeline and where the break in communication happened. He suggested that the other agent hadn't known for sure if the tenant was moving or had found out after closing.

He said he felt bad about the situation, though, and offered to give me all kinds of advice on how to lease it out quickly, get referrals for needed repairs, and minimize my expenses. I was glad he was talking so much because I was crying a little and didn't want my voice to shake on the phone. So now there's nothing to be done, really. It's not as if I can or would sue them or fraud, even if they were lying.

I just have to immediately make the slew of repairs and upgrades needed on that unit and rent it out (which will cost thousands and thousands of dollars, and now I have to do them all at once). I called the adult entertainer/tenant back and requested that she give me a call.

Told her if I didn't hear from her within a day or two I was going to have to change the locks. She's probably back in Arkansas by now though. UPDATE: The tenant in question just called me back. She's been planning to move since before Christmas and told the previous owner so at that time. Which very coincidentally happens to be when that owner listed the property for sale.

Both women seem very sincere and genuine (previous owner and tenant), and I have no doubt the seller's agent knew about the situation. At the very least it would have been mentioned once my lender requested a signed lease from the tenant. She'd never had a lease, so they drew one up. They dated it February 2007, not 2008. I didn't even catch it, and neither did my lender. What kind of lease would appease a lender that expires one week after the closing?

Do Realtors Lie - Do Consumers Get Justice ? EVER...

Buying or Selling a Home - realtor lied?

Expert: Todd Thornton - 6/23/2004

Question

Hi Todd!I contacted a real estate attorney .According to him the chances of winning a case against my realtor are very slim .First of all he thinks I could have measured the house myself before signing the papers and discoverd the problem .

Also ,he thinks that the realtor will most likely blame it on the seller and say the seller gave him the wrong numbers. The attorney suggest I may have a case against the seller , but ,again ,slim chances of a positive outcome (especially since the seller moved out of state). He said that I could write a letter of discontent to the realtor and his agency and ask for compensation(somwhere between $8,000-$10,000) but he doubted I would get it.

I still haven't given up on this.I still feel I was cheated.I find it strange that ,in case the seller gave the realtor the wrong numbers ,the realtor didn't verify them.Isn't he supposed to make sure the information is accurate?

If he's not ,does it mean I could get a realtor to list my house and tell him to list the house as 820 sqf instead of the 718 , and then hope somebody would fall for it?I am not sure what the realtor's responsability is.I read on the National Association of Realtors' website ,in Articol 2 of the "Code of Ethics and Standards of Practice" that : "Realtors shall avoid exaggeration, misrepresentation or concealment of pertinent facts relating to the property or the transaction."Also : "Realtors should only be obligated to discover and disclose adverse factors reasonably apparent to someone with expertise in those areas required by their real estate licensing authority."

The realtor responsible for the listing of this home claims to have 17 years of experience. That is a bit strange ,since the Minnesota Chamber of Commerce issued a licence for him only less than 16 years ago ,in the summer of 1988.Still ,with 15 years or more in real estate shouldn't he have noticed that the seller may have been lying to him (if that were the case) ? Or did he list the house without even looking at it? I am sorry to take so much of your time.

If there's no way for me to get compensated for those 62 square feet ,I would still push to get this realtor's licence suspended if possible.Where or whom can I contact to report this problem?Thank you again!Alin Mogosanu-------------------------Followup To Question - Hi Todd!Thank you for the fast response and for the advice.

I measured the house following your instructions and I ended up with 718 sqf .So,the realtor did exagerate the size of my house ,wheather on purpose or through negligence.

I will contact a Real Estate Attorney to see what I can do about it.Digging through my papers related to the buying of this home ,I also found a flier in which this realtor is advertising the house as having 2 bathrooms. Not true. The only way there could be a second bathroom is if that bathroom were entirely located in those fictitious 62 square feet.

I think this non existing bathroom and the exagerated square footage would prove either negligence ,not to call it stupidity, on the part of this realtor or that his marketing strategies are so agresive that he lies ,he will say whatever it takes to get people to look at his listed properties.

Thanks again Alin-------------------------Followup To Question - Hi Todd!I purchased a home in the summer of 2002 in Minneapolis ,Minnesota. It is a single family home and it was advertised as a 780 square feet house (foundation size 780 sqf and above ground square footage also 780 ).

However ,now, two years later I found out that from the City of Minneapolis property information web site that my house has a foundation size and above ground square footage of only 718.I know there's not much difference from 718 to 780 sqf ,but I am angry to see I have been lied to.

Is there anything I can do about this?I feel I've been cheated.Do you have any suggestions ?

Thank you AlinAnswer - Alin,It is possible that the city information is incorrect. I'd suggest you look at your appraisel. (request a copy from the bank if you didn't get one at closing)or you could measure the home youself.(which you'd need to do anyway to double check the figures) The measurement is length x width. For instance 26x30=780. There could be different ways of measuring depending on the area, but the most common for a single family would be measuring on the outside of the home. The real estate agent may not have lied intentionally. They could have measured the home incorrectly or taken the measurement from another source that was incorrect.

Assuming the 780 is correct, you could contact the agent and ask to be reinbursed for the difference in square footage.

The broker of the real estate office would be the contact person you'd need to call. You could figure out how much per square foot (from the appraisel)you'd need to multiple by (62) as to an appropriate amount to ask for. I'm not sure about Minnesota, but most agents are required to carry errors and ommission insurance which could cover this issue. (Assuming it was not intentionally done) If the error and ommission company won't pay, you could press the issue by filing a complaint with the real estate commission in your state.

FYI- Most real estate contracts state in the fine print the information given to you is not guaranteed as accurate.

That doesn't excuse the agent for giving you incorrect information. If the agent (or there broker) refused to work with you to rectify the situation, I'd suggest contacting a local attorney. In fact, you may want to go ahead and contact one now to explore your options.

Real estate law is state specific so they would have information on how judges or a jury have reacted to previous cases. Good luck and I hope everything works out.
Sincerely,Todd Thornton

Answer - Good luck and I hope everything works out for you.
It sounds like you will have a pretty good case.
Sincerely,Todd Thornton

Harris & Taylor Century 21- Oregon Real Estate - Realtors that Suck...

“Woman shows sign of trouble” Linda Acosta says she was lied to and damaged by Harris & Taylor (Century 21) Real Estate; real estate company says lies were “honest mistake”

By Edward SnookInvestigative Reporter

Gold Hill, Oregon – Linda Acosta and her late husband Bob purchased their home in November of 2001. They were assured by their real estate agent Jeannie Moore that their property was backed by Bureau of Land Management (BLM) property. This supposed fact gave them the assurance no one would be building behind them. This is what they wanted and believed it was what they purchased until they found out, after spending considerable time and money on the property that Harris and Taylor Century 21 Reality had lied to them. Their property actually was backed by private land.

There were other lies told to the Acosta’s such as that the roof was in good shape when it wasn’t, bad drainage problems, etc. As the Acosta’s were in California they trusted that Jeannie Moore was telling them the truth about the conditions.

Daily Courier Damage Control!

In October of 2005, Linda Acosta was contacted by reporter Howard Huntington of the Daily Courier. Huntington wanted to do a story on the sign Acosta had placed on her property and the reasons for the sign. The entire story had already been covered months prior by the US~Observer, so why did the Courier need to do an article. A prudent guess would be that someone from the real estate company contacted someone at the Courier to do damage control for them. Huntington’s article was published by the Courier on November 4, 2005 and as expected it contains numerous lies, making the real estate company look much better than they should.

First off Huntington gives the sale price of $395,000 and states that the “sale included two adjacent, three-bedroom homes.” There is only one three bedroom home. The other is a two bedroom apartment that was built over an existing barn/garage. Huntington’s intentions are all too obvious.

Huntington’s article continues, “Century 21’s attorney, Mark Clarke of Medford, said in a letter to the Daily Courier that the sale price was consistent with the local market.” What in the world does this statement have to do with anything?

The Acosta’s purchased a property that had been on the market for a long time and it was sold to them as backing up to BLM land. They had poured well over $125,000 into the property when they discovered they hadn’t purchased what they were sold.

Ms. Acosta has continued improving the property to this very day simply because she has no other choice. After the death of her husband Robert Acosta, Linda is now on her own and in no shape for the enormous task of finding another property, moving and having to start all over again.

And what in the world is attorney Mark Clarke doing writing a letter to the Courier when his Oregon State Bar rules state that he cannot use the media to enhance a case. So much for rules… The lies continue… “Another Century 21 attorney, Arne Cherkoss of Medford denied all of Acosta’s allegations. He said Acosta did not use the procedures in her contract for resolving disputes and rejected Century 21’s offer to deed to her a strip of land connecting her property with the BLM’s.

No offer has ever been made to Ms. Acosta and apparently Ms. Acosta has followed proper procedures because the issue has already been ruled on in court. In fact, Century 21 conveniently came up with paperwork after a Medford judge had ruled against them. When they asked the judge to re-consider based on the “newly discovered document” the judge denied them and stated that he wouldn’t rule on possible fraud because he didn’t have to.

Huntington should donate some time to the US~Observer in exchange for us teaching him to properly investigate and print facts as opposed to lies. As for Ms. Acosta she recently informed us that she intends to keep her sign up until Harris & Taylor Century 21 Real Estate Company is held accountable. Acosta stated, “if this sign isn’t large enough I’ll purchase one that is.” As for threats from the company of them filing a law suit against Ms. Acosta for posting the sign she says she is quite ready.

Since the Observer began publishing articles on the Acosta case we have had numerous horror stories reported by people who claim to have been lied to by Harris & Taylor Century 21 Real Estate Company. The following is one such case.

A New Case of Severe Abuse

In December of 2004, David and Paula Knobloch purchased their home on Cloverlawn Drive in Grants Pass, Oregon. Harris & Taylor Century 21 Real Estate was the company selling the property and Toni Epperson was their agent.

Paula Knobloch, who had just been diagnosed with cancer, would soon experience problems nearly equaling her bout with the cancer.

On the weekend the family moved into their home they ran out of water and sediment began coming through the pipes in the house. They immediately called their realtor and according to the Knoblochs they were told that it was probably a temporary problem from the pump etc., not being used. The water did return, however they still ran out of it in short order over the next few weeks. They then contacted a local water service and were informed that they should have the well tested and they should also test the water.

Paula had been sick during her time at the new (to them) home and had attributed the illness to her cancer treatments. As soon as the water test results came in the family was informed that the well was contaminated and that it was producing less than two gallons of water per-minute. They started drinking bottled water and immediately Paula started feeling better. Her doctor later informed her that she was fortunate to have found the problem when she did. As for the low gallons-per-minute issue the Knoblochs state that they were told by both Toni Epperson and the sellers that the well produced at least 5 gallons-per-minute or better.

The Knoblochs had no idea that their problems were only beginning. They found carpenter ants, yet they were informed on a walk-through prior to closing that this was normal to have some ants come into a home once it was vacant. Their realtor assured them by stating in front of several witnesses that there had been a pest inspection on the house.

Next, the Knoblochs began having septic and electrical problems and they recently found that there was flooding going on in a portion of the basement when they had a heat pump system installed. As soon as the heat pump began working Paula once again became ill and it was soon discovered that there was mold in the basement that was caused by the moisture.

When the problems with the septic continued the Knoblochs decided to attempt to find the company that had worked on the system for the previous owners. They located the company and were informed that the previous owners were told they would need a new system before long. Like all the other severe problems this was never disclosed to the Knoblochs.

Just like the Acostas, the Knoblochs inform us that they were either ignored or lied to when they attempted to get Harris & Taylor Realty to address their problems. As a result they are currently looking for legal counsel to represent them against the obviously unethical realtors.
Editor’s Note: Don’t miss our next edition wherein we will address this tragedy in more detail. Anyone having problems with Harris & Taylor Real Estate is urged to contact Edward Snook at 541-474-7885.

the Real Price of a Lawsuit

the Realtors Win, their E and O insurance Protects them FROM you.. You Lose. It does not matter how much proof you have against the Realtor the system is in place to protect the Realtor, Why, they are Billionairs and they Lobby Government Agencies and Law makes to create laws - to make it so that REALTOR - NAR is so big no one can touch them.

Consumer spend years fighting for the Justice that is Rightfully theirs. And though the Realtor really did hurt the consumer, waste years of their life, take away their assets and cause Emotional, Physical and Financial Damage ~ the Realtor gets away with it. NAR does nothing to help the real estate consumer. Though NAR pretends that this is their whole purpose for existing.. Again.. Flat Out Lie.

After Fighting for Years, whether the Consumer that was wronged wins or not People Get Frustrated, they get tired and after years of fighting against the REALTORS and of course, Losing, they just want their life back so the stories go away.. I am Dedicated to the Stories of Realtors hurting the Real Estate Consumer Staying Alive.

My other Blogs are www.CrystalLCox.com www.BrokersAdvice.net .
The answer that NAR - and the Laws they push for have is to SHUT the Consumer up, to make it so their frivolous lawsuits are Stopped by law, and to continue to strive to make it harder for the Real Estate Consumer to get any Kind of Justice from the Realtors that harm them. The E and O insurance of the Realtors is a Very Big Part of this.

This is insurance is to get rid of those darn frivalous lawsuits that consumers have and to Defend the Realtor. It is in NO WAY the Intention of the Real Estate E and O insurance to Protect the Real Estate Consumer. Yet Oddly Enough, and in complete shocking wonderment, E and O insurance is Mandatory By Some State Realty Commissions - Regulations. Do they think that this insurance is to Protect the Public or do they believe that the public is simply liying about the Realtor for Self Gain.

Though What I see is People simply want justice in these situations where it is VERY obvious and easily provable that the Realtor harmed the Consumer yet the Realtor Pays Nothing and is Free to do Damage to the Next Consumer.

Post on this Blog, Email your Story or Videos to Crystal@SavvyBroker.com , Video tape the lies and fraudulant acts of your Realtor and send them to me. No One is Really Listening to you. No One is Really Protecting you, the Best thing to do is to Expose the Realtors that are harming you.

If these Realtors were MADE to be accountable for their actions, the Good Realtors and their are some out there - they would be able to do their jobs for your best interest. But as the system stands now it is impossible for an Honest Realtor to Protect you in the Current Real Estate Industry Climate.

The Real Price of a Lawsuit is Your Life, your every waking moment, your sleepless nites, your life in shambles and the kick in the head while your already down with No Justice against the Realtor that Lied to You and is allowed to keep on making money Hand over Fist while you wait years for a "settlement" or for a judge and/or jury to have mercy on you.. the REALTOR wins no matter how you look at it...

"Evil Realtors Suck.

Wednesday, August 02 2006 @ 05:12 PM EDT

I just got a tip from my wife that the brother of a friend of ours is having trouble with Weichert Realty over in Jersey. It seems they're doing nothing to honor a listing contract for his house, yet they refuse to let him out of the contract.

It sounds like the guy who runs the office is on some kind of power trip and is doing what he's doing out of grade-school level spite. If you're in Jersey you probably know about this company - I think they're one of the biggest realtors in the state, and I remember that they used to have a half-hour infomercial on NYC TV stations a few years ago. At any rate, they suck. My friend's brother put up a site about called Why Weichert Sucks. Go check it out. "

Who Will Listen to the Real Estate Consumers Crying OUT? Will it be the National Association of Realtors and their Supposed "Higher Standards". Or do Real Estate Boards, Local Realtor Associations and the NAR simply say, oh this person is just disgruntled and was not really hurt - this is a frivilous claim made by a supposed real estate consumer, or does the National Association of Realtor just flat out ignore the Public's Plea for help with the Realtors who are Hurting them EVERY single Day. Find out the Truth About the Realtors ...
r
r
You Will Note that the Why Weichert Sucks Website
is Gone, this was Written in 2006 so We Will Post a Few Tidbits Below from the Old Website of WhyWeichertSuck.com which does not exist anymore... So Lets Re-Visit what that Site said when it was Still Up..
******
r
Why This Site?

Because people at Weichert Realtors tried to bully us, and we're sick of it.
John Geaney, the manager of the Upper Montclair office, was coercive and unethical.
We escalated to Larry Mueller, a VP at corporate. He didn't listen to us, he was belligerent, and he tried to stonewall us.

Jim Weichert, President of Weichert Realtors, ignored us.
The story is here.

Our agent isn't perfect, but we're not complaining about her. We'll call her "R" throughout these pages.

They pretty much have us over a barrel -- our listing contract runs until mid-September 2006, and they refuse to release us from it.

Fine. Maybe we're legally bound to them for a while. John and Larry even seem to enjoy telling us that there's nothing we can do about it. The contract, though, doesn't bind us to stay quiet. Since this is the only recourse we have, it's the recourse we're taking.

We understand that there are two sides to every story. If they want to put a rebuttal on Weichert.com, then, in the interest of fair play, we'll add a link to it here.

Please read, and feel free to share with your friends, blog about it, link to us, and add your comments to this site.

Jake and Sue Freivald
P.S. Although we are grateful for all of the support we have been getting, please, please do not do anything illegal. I'm saying this in all seriousness, without a wink: I would hate for our overall message to get drowned out by accusations of illegal activity. Thanks for understanding.
As It Stands Now

Background If You Want It
I've broken the story up into several parts:
Background, including our first encounter with John Geaney
John Geaney: Coercion attempt
Larry Mueller: Our attempt to escalate the problem
Email contact with Jim Weichert until the present (this page)
For all the details, start with the background. You'll eventually get led back to this page.
If you don't want all the details, start right here. There's a synopsis of events, and links to relevant information if you want to dig deeper.

Our Email to Jim Weichert: 7/26/2006
At around 9:00 AM Eastern time on July 26, I sent an email to Jim Weichert, president of Weichert Realtors. I carbon copied Larry Mueller, who likes to talk as though he's very important -- he's a Vice President of Something Or Other -- and John Geaney, the manager of the Upper Montclair office of Weichert Realtors.

Why email, instead of a phone call? If you read the background, you know that Larry Mueller had promised us that we'd never get higher in the organization than him. I'd leave a message for Jim, and Larry would return it.

But who knows what Larry is telling Jim? I wouldn't put up a site like this without being sure that the president of the company had a chance to resolve the problem first. The only option I had, then, was email. This is what I sent, with a few side notes and links added to flesh out the scenario.
*****
Jim,

From their Web site: "Each WEICHERT® franchised office is independently owned and operated." My beef is with the people I've named. The people in your local office may be quite nice; just pray that everything goes well so nothing has to get escalated. We want out of the our [sic] contract with your company. Our dissatisfaction stems from the unprofessionalism of your staff and our strong sense that they are not working in our best interest.

Specifically:

There's a lot behind this. When John Geaney pretends that it's our fault that the house didn't move, he conveniently ignores the fact that his office failed to do its job. Details here.* For five weekends this spring, Weichert failed to provide open houses and advertising for our house at [address removed] in West Orange, NJ.

This was at the meeting in January, well before they had missed all of the open houses, as detailed on the John Geaney page.* John Geaney demanded a listing price reduction that even his own realtor thought was unreasonable.

This was well after the January meeting, in June, after they had already missed five open houses. Again, details are here.* When we tried to reduce the price, but not to the level he wanted, he rejected the terms and said that he would not advertise it or run open houses unless we agreed to his price.

* We told him that, if he wasn't going to market the house, we wanted out of the contract. He refused to release us.

We're being advised that perhaps it's not technically "blackmail", but it was unethical coercion. Either way, I would hope that Jim Weichert would respond to clients who felt that their office manager had tried to blackmail them, regardless of the technical legal language. That was blackmail: he wouldn't let us go anywhere else _or_ do anything to move the house unless we kowtowed to his demands.

Such unprofessionalism is unworthy of the REALTOR brand, and we are likely moving forward with an official complaint describing this as a violation of Article 1 of the National Association of Realtors Code of Ethics.

Furthermore:

Detailed on the Larry Mueller page. I don't mind that he checked with John before reacting; but his reaction was out of line.* Larry Mueller treated us with hostility. Originally he said he wouldn't discuss the issue until he had talked to John. The next day, he refused even to let us speak: he continually said "let me finish" without ever providing an opportunity for us to discuss our side of the story. While technically not unethical, this was one of the rudest responses to a customer complaint I have ever seen.

* After this conversation, Larry took control of our account personally, explicitly telling us that we would never get to anyone higher in the organization and that even our realtor was no longer allowed to negotiate with us.

* He also refused to let us out of our contract.

There is no question that we feel that we are "stuck with" Weichert at this point -- hardly the impression that you would like our neighbors to have about your company. We reject their intimidation tactics, their stonewalling, and their arrogance. We hope you do, too.

We want out of our contract. Please advise us as quickly as possible about what you're willing to do in this regard.

Thank you,
Jake and Sue Freivald

Jim Ignores Us, Larry Eventually Responds: 7/27/2006
We didn't get any response that day. The next morning at around 8:00, I sent a follow-up.

Jim,

Still no response from you. I'd like a decision, please.

Thank you,
Jake Freivald

What follows is a transcript of the voice mail I got that morning.

Yes, hi, Mister Freivald, this is Larry Mueller from Weichert Realtors. It is Thursday morning, about 10:30.

I saw your emails, and Jim asked me to give you a call again to just reaffirm with you that yes, in fact, it is I that you will be dealing with going forward. I've spoken with [R]. Unfortunately, I do understand that the transaction that you were working on has fallen apart. I also know from [R] that she is planning to do an open house next week, and that we are putting the house in for advertising and marketing, and that we will continue to try to sell your house between now and the expiration of your listing.

And so, just to make it clear, which I thought we had in our last conversation, no, we are not releasing your listing, and yes, we will continue to honor the contract moving forward to sell your house.

If you have any questions, feel free to contact me 973 ### ####. Thank you.

Update: 7/28/2006, 10:50 AM
I just got a call from Larry Mueller of Weichert Realtors.

He said he has received "a few of the emails" and doesn't know whether I want him to respond to them, to give them facts about his side of the story, or whatever -- but, he said, that doesn't change anything.

I said, "Larry, I didn't even ask them to send you anything. I'm disgusted with you. I have things to do. I gotta go." And then I hung up.

The funny thing -- and the thing he probably doesn't get -- is that I really didn't ask people to send him emails (though I'm grateful that people have done so), and I didn't think I was going to strongarm him into granting any concessions.

This really isn't about the contract or the money at this point.

This is about the way he and John tried to intimidate us, to make us feel helpless. The way he spoke to my wife. The way he wanted R, who has actually stood by us (albeit imperfectly), to eat her commissions, while neither he nor John's office would do anything to set things right.

Those things can't be undone. They don't go away with concessions.

If you're reading, Larry: I don't care if this changes anything or not. You do your thing, and I'll do mine.

Update: 7/30/2006
She may have intended to have an open house this weekend, but there wasn't one. After the last deal fell through, R didn't get the advertising done in time.

Update: 8/2/2006
It looks like there are a few offers coming in. Mostly low-balls, including one that's coming back at the same price they did a few months ago.

It's worth noting that we haven't had an open house since June.

Update to the update: I just added a counter at 4:12 PM to keep track of our visitors. Thanks for coming!

Sold at last. I'm still angry at Weichert Realtors, and it steams me that the management of that company gets $10,000 in commissions.

Traffic is good: we've added almost a thousand new visitors over the past four days.
I worry whenever I see reactions like that of Antonio from Bloomfield from this morning on the comments page. Not because he calls me a whining calculating ignorant cry-baby -- I've got brothers, do you think I haven't been called worse? :) -- but because he misses the point. He says:

I would of taken steps against Weichart (a rather obtuse choice of a realtor) rather than worry about individuals. Your contract is between you and Weichart, not you and the agent or Larry or so on...

I am definitely not happy with being left in the contract, but, as is fully detailed here and elsewhere, it isn't the contract alone that makes Weichert suck. It's the specific people who treated us as they did: John, Larry, and (by not caring) Jim. People are the business. And Jim Weichert knows that: he said himself, "People buy people before they buy a product or service."
By the way, Antonio, why did you say that Weichert is a "rather obtuse choice of a realtor?" Do you have a story to tell?

On another note, thanks to all of you who are posting to the comments page. Also remember that any blog entries or Web sites that link to this page help us in our search engine rankings, so please feel free to add links in your blog entires and comments on other blogs.
Thanks!
All Quiet on the Western (Orange) Front
It has been a busy couple of days for other tasks -- I'm traveling, among other things -- and today is the last day of the attorney review period for our offer, so I don't have a lot to say.
Some people have asked me if Weichert knows about the site. We've seen some traffic over the past few days from their Morris Plains HQ, and from somewhere near Union, NJ. I didn't try to place any demands on them, though (Larry seems to like to say "this doesn't change anything", so I didn't try to change anything for him with respect to this site), and I don't know what options they're considering. I haven't heard from them directly.
Update: 8/8/2006
I've been advised -- not by a lawyer, but I'm listening all the same -- that the term "blackmail" may not be technically appropriate for what John Geaney tried to do. I've therefore removed it from the site and replaced it with some form of "to coerce" everywhere except in the place where I quote my email to Jim Weichert.
This reflects my general attitude about this site: anything that should be corrected will be corrected, and publicly. If Weichert Realtors can show that I've made any error of fact, I'll change the site to reflect the problem, and apologize if appropriate. And, as I have said from the beginning, if they have a different view of what happened then I'll post a link on this site to their rebuttal on Weichert.com.
Update: 8/7/2006, Evening
I just responded to the comments on the Northern New Jersey Real Estate Bubble Web site. (Grim's readers are voracious, and now account for the vast majority of visitors.) I'm posting my response in its entirety here, lightly edited to fix some lousy grammar. Warning: it's long...
Hi all,
I'm Jake of whyweichertsucks.com. I want to thank you for your interest in the situation, whether you're pro or con me personally, and to answer some of the questions that have been asked here.

I've broken this into sections.

1. The nature of the grievance.

Some people seem to think that I put up the site because I didn't get the price I wanted for my house. That's not really the case.

the branch manager threatened to reject the reduction that we and our realtor agreed to; and then to refuse to run open houses or market it because, at that price, it wouldn't sell -- so it wouldn't be worth it to him.

Nobody's happy to see a house go for less than they wanted, but I knew in November that I had just bought a house at a high price, and that I was going to sell my old one at a low price. If that had been all that happened, we wouldn't be discussing this.

2. Price
I'm not a real estate pro, and I didn't really even watch the market until I had a house to sell. I have only one indicator at my disposal to determine what "the right price" is: what the market bears. For most of the time that it has been listed, this house has been the lowest-priced house in its area.
The anonymous poster who claimed familiarity with my house was most aggressive, so lets start with his/her post.

1.) The house was over priced to begin with--much better > homes off the main street at $445K
That's $85,000 more than we were asking, and we are accepting an even lower price. It's true that you can get much better if you're willing to pay 23% more, but I'm not sure how that's relevant.

2.) House in on a main street--heavy track. Always expect > less!

This house has been priced less than anything surrounding it for months, often much lower.
The house across the street from ours just went a few months ago for just under $500K, at a time when we were asking $380K. There are differences, of course -- that house was updated, and its driveway is on the side street -- but the point remains that we already expected less for a variety of reasons.

3.) If you don't update your house, then how can you compete? The panelling is what? 1950s? > 4.) Neustral colors work for everyone--buy a gallon of > paint! what a novel idea!
1970's, probably :) and the pictures are out of date. That upstairs section has been fully repainted for several months. I actually think it looks less warm, but to each his own.
The real question, though, is "compete with what"? The price was always the lowest in a fairly large radius, and we've gotten offers well above what we're getting now; they've just fallen through.
> The house is probably worth $285.
I can only accept this if you're working on some esoteric formula for "worth" that differs from "what the market will bear." If you really think that the house should only _get_ $285K, then, with all due respect, you clearly don't know this market.

> Has is sold? I believe it has been on the market forever!
We went under contract (again) this evening. We had an offer for $370 in March, one for $365, one for $355, and the most recent one. (I don't know the rules -- am I allowed to disclose that price yet?) Each has fallen through for one reason or another, but the fact remains that these are the prices that the market was bearing at the time. I'm not sure what else I should go by: on what other basis should I rationally adjust my pricing?

Anyway, yes, we listed it in November because we had just closed on our new house in October. (Remember that we have a big family, and we couldn't risk selling the old place without having a spot to park us and our six kids.) The listing was "refreshed" in March. During the spring it was definitely underexposed, and you can't sell anything if people aren't brought to it.
3. My attitude
A different anonymous poster said:
> I would disagree, my dealings with Weichert, in general, > have been fairly positive. ... It probably depends on what > office you are working with.

My motto is "it's all about the guy" -- the specific person you're working with can make all the difference in the world.
As things start to escalate, though, people higher up should be able to solve more problems, not cause them. John Geaney of the Upper Montclair office was the unethical party; Larry Mueller, the regional VP, didn't help solve the problem and instead was a jerk to my wife, and Jim Weichert just doesn't care. The latter two faults are less egregious than John's, but they still aren't good business practices.

> The seller, in this particular case, is at fault. Peoples > expectations have just become unrealistic. Yeah, you're > neighbor got a great price on his place 2 months ago. > Well TOUGH! You aren't getting that price, so accept what > you are getting.
I would accept this if we weren't already the lowest priced house in a sizeable radius, but it's still not the nature of the grievance. If this were just about price, I wouldn't have a Web site up.
Someone else said:

> 2. The seller doesn't want to hear that he should expect > to net 15% less in the gross sales price than expected.

It's true that I don't want to hear this, but I have tried to be reasonable about what the market was bearing at the time. I suggested a reduction to my realtor first, for instance.
Weichert's not innocent in that [EDIT: i.e., in the lower price that I ultimately had to accept], because they underexposed my house in the Spring. There were mitigating personal circumstances with my realtor that cause me to not harbor a grudge against her, but things could have been much better.

But that's not the point of the site: its point is that John Geaney threatened me with the loss of thousands in mortgage payments, and his regional VP rudely stonewalled us when we tried to complain.
===== 4. Contracts -----
> By the way, when you sign a contract, you should read the > fine print.
This is the thing I kick myself most for, and also one of the reasons I'm most upset with our realtor. We trusted her, and she didn't make it clear that this was an extension to our exclusivity. I doubt that she intended it, but that's the way it was anyway. As someone said:
> That really "terrific" agent R("you buy the people") > sounds like she's a nice person who doesn't cover contract > details. She didn't do her job. Either that, or they do > good cop, bad cop there.
I'm usually a stickler for contracts, too, but we were in a hurry, and haste makes waste and all that. I've got nobody to blame but myself for that one.
> I'm quite surprised they weren't let out of the listing.
So was I. I think it made better business sense for them to cut their advertising losses if they thought I was a crazy client who overvalued his house. Even if they end up quashing me like a little bug, their legal fees alone will cost them more [EDIT: than the amount of advertising money they would have lost if they had released us from the contract].
I seriously wonder whether it's not a power trip, but I don't know these people well enough to say.
> I think one of the words they use on their site is ill- > advised.
Which word is that? I'll happily change things if I'm saying something the wrong way.
===== 5. Miscellaneous -----
> Can you not have multiple agents? If one doesn't work, > make a contract with another.
I spoke to another agent, and they said they were bound ethically and legally not to work with us while we were under contract with Weichert.
> 1. The office manager is trying to generate sales/revenue > so he is pushing the seller to drop the price in order to > move the transaction along.
Several people have commented that the office manager and I have different goals. I agree, and acknowledge that any business transaction is a compromise between parties with different goals.
I don't object to his desire for a lower price. I object to his use strongarm tactics to force me to agree.
=====
This is probably a lot longer than anyone really wants, but there it is. I'll also post this to the whyweichertsucks.com so that everyone can benefit, and if anyone has other specific questions or comments I'll answer them as best I can.
Regards, Jake
Update: 8/7/2006
I found this choice quote from Jim Weichert today: "People buy people before they buy a product or service." That's why I went with R at first, Jim, and that's why I now repudiate John, Larry, and you.
Anyway, there was an open house yesterday, but very little traffic. R said it might be that way; the season isn't great for foot traffic right now. I haven't yet gotten a paper to see whether advertising was done as promised, but I'll check that out today.
We currently have three options:
Pull the house from the market until mid-September for a guaranteed loss of mortgage payments and relatively strong potential for additional price deflation.
Let R continue to work the house for a higher price until September, with high risk of additional mortgage payment loss and relatively strong potential for additional price deflation.
Let the vultures feast (though even this option isn't risk-free).
Given all of that, we're opting for the lattermost. We're accepting an offer today, unfortunately, to try to get out from under this boat anchor.
What's most frustrating about this is that I hear John's smug little voice in my head saying that if we had followed his advice earlier on, we'd have gotten this over with months ago for the same price. I know, as does anyone who has followed this listing, that the house was underexposed: we could have had it done months ago at a higher price if everything had been done right.
But arguing that point won't save me thousands in mortgage payments.
----------

A friend sent me this link about the March 2006 reinstatement of a lawsuit against Weichert Realtors for consumer fraud. Worth reading.

The unanimous ruling by the three-judge court reinstates a lawsuit against Weichert Realtors by a couple who thought they were buying a house in the "more prestigious" Montville section of Montville Township, Morris County.

In fact, the house was located in the township's Towaco section, according to the ruling. It added that the buyers, Theodore and Francis Vagias, discovered that when "they were unable to send their son to the highly rated elementary school in Montville."
Update: 8/4/06
R is back from London. She told me that they normally only do advertising in either the New York Times or in the Star-Ledger, but not both, and it's only for the date of the open house. She put the advertising in herself, and I trust her on that.
John Geaney called to say the same basic stuff about advertising. He also said that the picture was corrected. He was perfectly polite. He either didn't notice or didn't want to let on that I had sent the email from the whyweichertsucks gmail account.
Update: 8/3/06
R is on vacation in London, so another realtor is acting as her surrogate for a few days.
I spoke to her last night: there are now two offers on the table for about $340,000. Clearly, they want to close the deal, and so do I; but both of these offers are retreads. We haven't had an open house since June. I want the house to get at least some exposure before I accept an offer out of desperation.
So we're holding off until we see what happens over the weekend. Of course, this is a lousy weekend for open houses -- remember all those we missed in the spring? -- so we may not get anywhere, but I want to at least try.
I'm waiting for a call back from R's surrogate to see whether the advertising was actually put in for this weekend. She said she'd check this morning. Even if she comes back with a "yes", I'm going to have to buy the Newark Star-Ledger and the New York Times to verify.
-----
It's 1:00PM now. R's surrogate says that "advertising is in", which apparently means the Star-Ledger but not the New York Times. She also mentioned something -- maybe the term was "leaflet"? -- that it was in, maybe like those things they hand out at grocery stores.
The offerers know that they're in competition, but I think it would be unethical to say more than that.
-----
Where the hell is my picture? [Now it's up, although they had to correct it.] The realtor had all of the photos I've posted here, including the one to the right, but look here (look for "[address removed after sale]") and here -- where is the photo?
-----
At 1:45, I sent this to Larry and John, cc:ing Jim Weichert:
Larry and John,

Two issues.

1. Our listing on Weichert.com has no photo.
You've had pictures for months. I have attached the one that's currently being used for our MLS listing. How come there's nothing on Weichert.com?
2. I talked to [R's surrogate], and she said that we have advertising in place with the Star-Ledger (at a minimum, though it wasn't clear to me if there are other media in which you advertise) for this weekend's open house.
I checked on nj.com, where the realty listings for the Star-Ledger are normally released, and I saw nothing yet.
I called the Star-Ledger, and they had nothing for this Sunday, but I couldn't tell whether advertising would have started earlier or not.
Please provide me with details of which outlets are being used to advertise this open house, and on which dates.
Thanks.
Your client,Jake Freivald
I got a voicemail from John Geaney:
Jake, this is John Geaney with Weichert Realtors in Upper Montclair. Just giving you a call, two things, wanted to let you know that the picture is up on Weichert.com plus some additional pictures and we have advertising in place in the Star-Ledger for your open house this Sunday. Okay? If you have any questions, give me a call, 973 746 1515. Thank you.
Indeed, the photo is up, and some additional photos besides. Unfortunately, he didn't use the photo I attached, which R and I had agreed was more flattering to the house. I replied by email at around 5:00 PM.

John,
Thanks for the follow-up phone call.
Two items:
1. Although
I appreciate the fact that there are now pictures of the property on Weichert.com, R and I agreed months ago (with the input of another realtor as well) that the main photo you have used doesn't show off the house very well. Please replace it with the photo R and I agreed on, which I have reattached to this email.

2. Advertising.
A. I think I understand you to mean that there will be an ad running in this Sunday's paper for the open house that is supposed to take place that same day. Is that the case? Is that the standard way you advertise an open house?
I would have thought that you would want to run something during the week as well, to give people time to plan, but I'm no expert. Please advise. B. I spoke to the woman at the Star-Ledger this morning, and gave her the Upper Montclair office's phone number as the billing phone number for the ad I was looking for. It sounded as though there was an account based on that number, but there was no ad for [address]. Will you please provide me with an identifier so that I can verify the ad through the Star-Ledger?

Thanks.

The Site is Retired
I'm still not happy with Weichert Realtors -- they've done nothing to make up for the way they treated us -- but I'm not going to keep the whole story up here any more.
